Terms of Service

Please read these terms and conditions carefully before using our services. By booking with Bucket List Travels & Tours, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing our website, making a booking, or using any services provided by Bucket List Travels & Tours ("the Company," "we," "us," or "our"), you ("the Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our services.

These terms apply to all bookings, enquiries, and services arranged through Bucket List Travels & Tours, whether made online, by email, by telephone, or in person. We reserve the right to refuse service to anyone who does not comply with these terms.

2. Booking and Reservations

2.1 Booking Confirmation: A booking is considered confirmed only after we have received the required deposit payment and issued a written confirmation via email. Verbal agreements or preliminary discussions do not constitute a confirmed booking.

2.2 Accuracy of Information: You are responsible for providing accurate personal information for all travellers in your party, including full legal names (as they appear on passports), dates of birth, nationality, passport numbers, and any dietary or medical requirements. Errors in the information you provide may result in additional charges or the inability to travel.

2.3 Travel Documents: It is your responsibility to ensure that all travellers hold valid passports, visas, and any other documentation required for entry into Sri Lanka, the Maldives, or any other destination included in your itinerary. Bucket List Travels & Tours is not liable for any consequences arising from inadequate or expired travel documents.

2.4 Special Requests: We will make every reasonable effort to accommodate special requests such as dietary needs, room preferences, and accessibility requirements. However, we cannot guarantee that all special requests will be fulfilled, and failure to meet a special request does not constitute a breach of contract.

2.5 Minimum Age: Travellers under the age of 18 must be accompanied by a parent or legal guardian. The accompanying adult accepts full responsibility for the minor throughout the duration of the journey.

3. Payment Terms

3.1 Deposit: A non-refundable deposit of 30% of the total booking cost is required at the time of booking to secure your reservation. For bookings made within 30 days of departure, full payment is required at the time of booking.

3.2 Final Payment: The remaining balance must be paid in full no later than 45 days prior to the departure date. Failure to make the final payment by the due date may result in automatic cancellation of your booking, and the deposit will be forfeited.

3.3 Payment Methods: We accept payment via bank transfer, credit card, and other methods as communicated during the booking process. All payments must be made in the currency specified on your invoice. Any bank charges or currency conversion fees incurred are the responsibility of the Client.

3.4 Price Changes: All prices quoted are subject to availability and may change prior to booking confirmation. Once a booking is confirmed and the deposit has been received, the quoted price is guaranteed except in cases of government-imposed taxes, fuel surcharges, or currency fluctuations exceeding 5%, in which case we reserve the right to adjust the price with prior written notice.

3.5 Third-Party Costs: Prices do not include international flights (unless explicitly stated), travel insurance, visa fees, airport taxes, personal expenses, gratuities, or any items not specifically listed in the itinerary.

4. Cancellation and Refund Policy

4.1 Cancellation by the Client: All cancellation requests must be submitted in writing via email to info@bucketlisttravels.lk. The following cancellation charges apply based on the date the written notice is received:

  • More than 60 days before departure: Deposit forfeited (30% of total cost)
  • 45 to 60 days before departure: 50% of total cost
  • 30 to 44 days before departure: 75% of total cost
  • Less than 30 days before departure: 100% of total cost (no refund)
  • No-show or early departure: No refund

4.2 Cancellation by Bucket List Travels & Tours: We reserve the right to cancel a booking at any time due to unforeseen circumstances, including but not limited to natural disasters, political instability, pandemics, or insufficient minimum group sizes. In such cases, you will be offered the choice of an alternative journey of equivalent value or a full refund of all monies paid.

4.3 Itinerary Changes: We reserve the right to make minor changes to your itinerary before or during the trip due to operational requirements, weather conditions, or safety concerns. We will notify you of any significant changes as soon as practicable and, where possible, offer suitable alternatives.

4.4 Refund Processing: Approved refunds will be processed within 14 business days of the cancellation confirmation. Refunds will be returned using the same payment method used for the original transaction.

5. Travel Insurance

5.1 Requirement: We strongly recommend that all travellers obtain comprehensive travel insurance prior to departure. Your insurance should cover, at a minimum: trip cancellation and interruption, medical emergencies and evacuation, personal belongings and baggage loss, and third-party liability.

5.2 Responsibility: Bucket List Travels & Tours does not provide travel insurance and is not responsible for any losses, expenses, or damages that could have been covered by adequate travel insurance. The decision to travel without insurance is taken entirely at the Client's own risk.

5.3 Pre-Existing Conditions: If you or any member of your travel party has a pre-existing medical condition, please ensure that your travel insurance provides appropriate coverage. We recommend disclosing all pre-existing conditions to your insurer at the time of purchasing your policy.

6. Liability

6.1 Limitation of Liability: Bucket List Travels & Tours acts as an intermediary between you and the various service providers (hotels, transport operators, guides, activity providers, etc.) that form part of your itinerary. While we select our partners with the utmost care, we are not liable for any injury, illness, death, loss, damage, expense, or inconvenience caused by the acts, omissions, or negligence of any third-party service provider.

6.2 Force Majeure: We shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, epidemics or pandemics, war or terrorism, government actions or travel restrictions, strikes or industrial disputes, and severe weather conditions.

6.3 Personal Responsibility: You acknowledge that travel involves inherent risks. You are responsible for your own safety and well-being during the journey. Activities such as wildlife safaris, water sports, trekking, and other adventure activities are undertaken at your own risk. You agree to follow all safety instructions provided by local guides and operators.

6.4 Maximum Liability: In any event, the maximum liability of Bucket List Travels & Tours shall not exceed the total amount paid by you for the booking in question.

7. Health and Fitness

7.1 Medical Conditions: You must inform us of any medical conditions, disabilities, allergies, or dietary requirements that may affect your ability to participate in any part of the itinerary at the time of booking. We reserve the right to request a medical certificate of fitness to travel where we consider it necessary.

7.2 Vaccinations: It is your responsibility to obtain any recommended or required vaccinations for your destination. We advise consulting your healthcare provider or a travel health clinic at least 6 to 8 weeks prior to departure.

7.3 Fitness Requirements: Some of our journeys include activities that require a reasonable level of physical fitness. Activity difficulty levels are indicated in the itinerary descriptions. You are responsible for ensuring that you are physically capable of participating in the activities included in your chosen itinerary.

8. Intellectual Property

8.1 Website Content: All content on the Bucket List Travels & Tours website, including but not limited to text, images, graphics, logos, icons, videos, and software, is the property of Bucket List Travels & Tours or its content suppliers and is protected by Sri Lankan and international copyright laws.

8.2 Permitted Use: You may view, download, and print content from our website for personal, non-commercial use only. Any reproduction, distribution, modification, or use of our content for commercial purposes without our prior written consent is strictly prohibited.

8.3 Trademarks: The Bucket List Travels & Tours name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Bucket List Travels & Tours. You must not use such marks without our prior written permission.

9. Privacy and Data Protection

9.1 Data Collection: We collect and process personal data in accordance with our Privacy Policy. By making a booking with us, you consent to the collection and use of your personal information as described therein.

9.2 Third-Party Sharing: We may share your personal information with third-party service providers (such as hotels, airlines, and transport operators) as necessary to fulfil your booking. We ensure that all such third parties handle your data in a secure and responsible manner.

9.3 Marketing Communications: With your consent, we may send you promotional emails about our services, special offers, and travel inspiration. You may opt out of marketing communications at any time by contacting us or using the unsubscribe link in our emails.

10. Changes to Terms

Bucket List Travels & Tours reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon publication on our website. The "Last Updated" date at the top of this page indicates the most recent revision.

It is your responsibility to review these terms periodically. Your continued use of our services following any changes constitutes your acceptance of the revised terms. The terms in effect at the time of your booking confirmation will apply to that specific booking.

11. Governing Law

11.1 Jurisdiction: These Terms of Service shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising out of or in connection with these terms or any booking made with us shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.

11.2 Dispute Resolution: In the event of any dispute, we encourage you to contact us directly to seek an amicable resolution before initiating any legal proceedings. We are committed to resolving complaints promptly and fairly. Please direct any concerns to info@bucketlisttravels.lk.

11.3 Severability: If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
